Peter Thorning was recently quoted in the Advocate Daily in relation to a decision by The Ontario Court of Appeal that re-affirms the obligations police have when detaining an individual at the roadside for the purpose of obtaining a breath sample. The decision also addresses the forthwith requirement as set out in s. 254(2) of the Criminal Code.

James Zibarras and Trung Nguyen successfully responded to a motion at the Court of Appeal for Ontario seeking an Order that the law firm, which is acting on a contingency fee basis, post security for costs on behalf of its impecunious client. In dismissing the motion, the Court of Appeal noted the chilling effect that such an order would have on the contingency fee regime in Ontario.
